I bought a new 2008 Tribeca two years ago. The great experiences of my friends and "subie" owners convinced me to go from Land Rover and Toyata to.......Subaru!
From day one, I experienced a hesitation at highway speeds and approximately 2000rpm. The vehicle switches into 5th gear before this rpm is reached and the slightest modulation of the accelarator to increase engine power, as in going up a slight incline or passing, causes the the car to produce a series of hesitations.
I have taken it into dealers repeatedly over the past two years and although they have admitted to the problem, they have not been able to fix it. Subaru Canada tech. people have talked the local dealer techs through the various attempts at fixing this issue, but to no avail. At the last visit to the dealer in Nanaimo, BC. (who was GREAT) they kept the car for a month in the hopes that they could go through everything. Subaru Canada finally acknowledged that there was no fix for the problem.
I have sent Subaru Canada registered mail, several emails and several phone calls, but they have apparently refused to so much as acknowledge any of them!!
I am disgusted with Subaru to put it mildly! I have made it my mission to make sure as many as possible hear of this!:mad::(.
Oh yes, squishy brakes and knocking front end...since new, too!!

If that is truly the case and there is a real problem and you went to CORPORATE and they refused you, A LAWYER is your next step.
SOA is good at taking care of things usually....so give it another phone call and ask to speak to that person's boss, or the next boss. If the problem is a tranny then get a new one, if soft wear then get a re flash.
BUT IF YOU REALLY don't like the vehicle, trade it for a different model and chalk it up to experience.
I have had to deal with SUBARU CORP. and they took care of my problem after talking to right individual. So I speak from experience. CALL and ask to speak to right BOSS especially after a HISTORY of fixes did not resolve problem. Not trying to blow you off. If the last person can't help you anymore and there is no higher to go then your option is legal advice or trade it in.

Have recently talked to someone in Customer service. Apparently my issue is on the manager's desk, what ever that means.
I like the Tribeca, It is basically a good car, just a problem with these issues.
Would like the vehicle replaced, actually. Think that is the only option after all the troubles I have had!
Chalking it up to experience would be a very expensive way to go. I think Subaru has definite responsibility to make things "right".

Just an update on last entry.
Have continued to try and get Subaru to acknowledge my emails, phone calls and registered letters. To no avail.
They appear disinterested. The problem with the Tribeca continues.
BE WARNED!!

Other option is if CORPORATE does not respond and you don't want to play with layers and their fees, sell it and get something else.
Tell your friends of your experience for to BEWARE of future buying of SUBARU in Canada. HERE IN THE U.S. it is a little different in regards to customer service and calling CORPORATE you will talk to someone for sure.
I am serious when I say dump it if no response after ALL POSSIBLE avenues have been attempted, it is not worth the stress.

Lemon Law? Do you have that in Canada?

No Lemon law in British Columbia.
Subaru called today and stated they find nothing wrong with the vehicle and what I experience is normal for that vehicle!
They suggest I just trade it in on another one!!! HA! Fat chance!! NEVER!
SO TO ALL YOU TRIBECA OWNERS, IF WHEN ACCELERATING OR GOING UP A GRADE IN TOP GEAR CAUSES YOUR CAR TO JERK.......DON'T WORRY, IT IS
"NORMAL".

Update:
Was called by Subaru Canada today with their "final verdict" on my 2008 Tribeca.
Was told what I experience is "normal for that vehicle".
Suffice it to say that if what happens to my Tribeca is "normal" per Subaru, maybe they should get out of the SUV market and stick to building their little cars.
Beware : 2010/2011 Outback 3.6 5-speed automatic. Very likely the same engine and transmission??
What they really mean is; "we don't know what is going on, and therefore can't fix the problem." They would not have invested in two torque converters and other parts plus hours of labor if there was no admission to a problem.
:tdown::tdown: Subaru.
